Do I need a solicitor for conveyancing?
While conveyancing can be handled by a licensed conveyancer, a solicitor can provide legal advice if unexpected issues arise. This can be particularly valuable for complex property transactions, rural properties, subdivisions, family transfers or contract disputes.
How much does it cost to prepare a Will?
The cost of a Will depends on your circumstances and the complexity of your estate. We provide clear, upfront advice and can discuss the most suitable option for your needs during an initial consultation.
What is the difference between a Will and a Power of Attorney?
A Will takes effect after you pass away and outlines how your assets are distributed. A Power of Attorney operates while you are alive and allows a trusted person to make decisions on your behalf if you are unable to do so.
When should I update my Will?
You should review your Will whenever there is a significant change in your circumstances, such as marriage, divorce, the birth of children or grandchildren, purchasing property, starting a business or receiving an inheritance.
What happens if someone dies without a Will?
If a person dies without a valid Will, their estate is distributed according to Victorian legislation. This may not reflect their wishes and can create additional costs and delays for family members.
What is Probate?
Probate is the legal process of validating a Will and confirming the authority of the executor to administer the estate. Financial institutions and government bodies often require Probate before releasing assets.
